Rental Agreement Basics

Agreement Formation

This rental agreement is formed between the Hirer and Humber Events Company upon confirmation of booking. The agreement becomes binding once payment has been received and booking confirmation has been issued.

Booking Requirements

All bookings must be made through our website. The Hirer must provide valid photo identification and proof of address via email to humbereventscompany@gmail.com when booking. The Hirer must be at least 21 years of age and hold a valid form of identification.

Equipment Description

The equipment being hired is a 60kVA generator, suitable for powering events, construction sites, and temporary power requirements. Specifications and operating instructions will be provided upon delivery.

Hirer Responsibilities

Duty of Care

The Hirer accepts full responsibility for the generator from the time of delivery until collection. The equipment must be operated in accordance with provided instructions and maintained in good working condition throughout the hire period.

Authorized Use Only

The generator may only be operated by competent persons who have been briefed on its safe operation. The Hirer must not allow unauthorized persons to operate the equipment.

Location and Security

The Hirer must ensure the generator is positioned on level, stable ground in a well-ventilated area. Adequate security measures must be in place to prevent theft or vandalism. The generator must not be moved from the agreed location without prior written consent.

Fuel Management

The Hirer is responsible for ensuring adequate fuel levels throughout the hire period. Only diesel fuel must be used. The Hirer must monitor fuel levels and refuel as necessary to prevent the generator from running out of fuel.

Prohibited Uses

The generator must not be used for any illegal purposes, overloaded beyond its rated capacity, operated in hazardous environments without appropriate safety measures, or modified in any way without written permission.

Loss and Damage Liability

The Hirer is fully liable for any loss, damage, or theft of the generator during the hire period, regardless of cause. This includes damage caused by misuse, negligence, accidents, theft, vandalism, or acts of third parties. The Hirer must take all reasonable precautions to protect the equipment and will be charged the full replacement value of £7,500 plus any associated costs if the generator is lost, stolen, or damaged beyond economic repair.

Return Condition

The generator must be returned in the same condition as delivered, allowing for fair wear and tear. The equipment must be clean and free from damage.

Pricing & Payment

Payment Before Hire

Full payment must be received before the generator is delivered or collected. We accept payment by bank transfer, credit card, or debit card. No equipment will be released until payment has been confirmed and cleared in our account. Payment must be made at the time of booking confirmation.

Security Deposit

A refundable security deposit of £500 is required for all hires. This deposit will be refunded within 7 working days of the generator being returned in satisfactory condition. The deposit may be used to cover any damage, cleaning costs, or outstanding charges.

Hire Period Extensions

If you wish to extend your hire period, you must contact us at least 24 hours before the scheduled return time. Extensions are subject to availability and must be paid for in advance. Unauthorized extensions will be charged at 150% of the standard daily rate.

Late Return Charges

Late returns without prior authorization will incur additional charges. Returns up to 4 hours late will be charged at 50% of the daily rate. Returns more than 4 hours late will be charged at the full daily rate for each additional day or part thereof.

Business Account Terms

Approved business customers may be offered account terms subject to credit checks and references. Account terms are typically 30 days from invoice date. A credit application must be completed and approved before account facilities are granted.

Additional Charges

Damage and Repair Costs

The Hirer will be charged for any damage to the generator beyond normal wear and tear. Charges will reflect the actual cost of repairs or replacement parts. In cases of total loss or damage beyond economic repair, the full replacement value of £7,500 will be charged.

Cleaning Charges

If the generator is returned in an excessively dirty condition, a cleaning charge of up to £150 may be applied. This includes removal of mud, debris, paint, or other contaminants.

Recovery and Collection Costs

If the generator needs to be recovered due to breakdown caused by misuse, running out of fuel, or other Hirer negligence, all recovery costs will be charged to the Hirer. This includes transportation, labor, and any associated expenses.

Incorrect Fuel Charges

If incorrect fuel is used (such as petrol instead of diesel), the Hirer will be charged for all costs associated with draining, cleaning, and repairing the fuel system. This can amount to several thousand pounds depending on the extent of damage.

Logistics & Site Access

Delivery and Collection

Delivery and collection times will be agreed upon booking. The Hirer must ensure someone is available to receive the delivery and sign the delivery note. If access is not available at the agreed time, additional charges may apply.

Site Requirements

The Hirer must ensure the site is suitable for delivery and positioning of the generator. This includes adequate access for delivery vehicles, level ground for positioning, and compliance with any site-specific regulations. Any special access requirements must be communicated at the time of booking.

Failed Delivery

If delivery cannot be completed due to inadequate access, unsafe conditions, or absence of the Hirer, a failed delivery charge will apply. A new delivery will need to be scheduled and paid for separately.

Equipment Care & Maintenance

Daily Checks

The Hirer should perform basic daily checks including oil level, coolant level, fuel level, and visual inspection for leaks or damage. Any issues must be reported immediately.

Breakdown Procedure

In the event of a breakdown, the Hirer must contact us immediately. Do not attempt repairs unless authorized. We will arrange for a technician to attend or provide a replacement generator where possible.

Unauthorized Repairs

The Hirer must not attempt any repairs or modifications to the generator without written authorization. Any unauthorized work will void any warranty and the Hirer will be liable for all resulting costs.

Safety Requirements

Operating Environment

The generator must be operated in a well-ventilated area, away from flammable materials, and protected from adverse weather where possible. Exhaust fumes must be directed away from occupied areas.

Electrical Safety

All electrical connections must be made by a competent person. The generator must be properly earthed. Do not exceed the rated capacity. Use appropriate cables and connectors rated for the load.

Fire Safety

Keep fire extinguishers readily available. Do not refuel while the generator is running or hot. Clean up any fuel spills immediately. Ensure adequate clearance around the generator for ventilation and fire safety.

Noise Considerations

The Hirer is responsible for ensuring operation complies with local noise regulations and restrictions. Consider the impact on neighbors and take appropriate measures to minimize disturbance.

Damage & Loss

Reporting Damage

Any damage to the generator must be reported to us immediately, regardless of how minor. Failure to report damage may result in the Hirer being held responsible for additional consequential damage.

Theft Reporting

In the event of theft, the Hirer must report the incident to the police immediately and obtain a crime reference number. We must be notified within 4 hours of discovering the theft. The Hirer remains liable for the full replacement value unless adequate security measures were in place.

Damage Assessment

Upon return, the generator will be inspected for damage. The Hirer will be notified of any damage found and provided with a detailed assessment and cost estimate for repairs.

Total Loss

In cases where the generator is stolen, destroyed, or damaged beyond economic repair, the Hirer will be charged the full replacement value of £7,500 plus any associated costs such as recovery, disposal, and loss of earnings.

Third Party Damage

The Hirer is responsible for any damage caused by the generator to third party property or persons. This includes damage caused by exhaust fumes, noise, vibration, fuel spills, or electrical faults.

Replacement Value

The agreed replacement value of the 60kVA generator is £7,500. This value will be charged in full for total loss or damage beyond economic repair, regardless of the age or condition of the generator at the time of hire.

Insurance Requirements

Hirer's Insurance

The Hirer is strongly advised to have appropriate insurance cover for hired equipment. This should include cover for damage, theft, and third party liability. Proof of insurance may be requested.

Our Insurance

Our insurance covers the generator while in our possession only. Once delivered to the Hirer, the Hirer assumes all risk and liability for the equipment.

Insurance Claims

If the Hirer has insurance cover, they must pursue any claims through their own insurance. We will provide necessary documentation to support insurance claims. The Hirer remains liable for any excess or uninsured losses.

Limitation of Liability

Equipment Suitability

While we ensure our equipment is properly maintained and fit for purpose, we cannot guarantee uninterrupted operation. The Hirer should have contingency plans in place for critical applications.

Consequential Loss

We will not be liable for any consequential losses arising from equipment failure, including but not limited to loss of profits, loss of business, or loss of opportunity. Our liability is limited to the hire charges paid.

Force Majeure

We will not be liable for failure to deliver or perform our obligations due to circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, strikes, or government restrictions.

Cancellation Terms

Cancellation by Hirer

Cancellations must be made in writing. Cancellations made more than 7 days before the hire start date will receive a full refund minus a 10% administration fee. Cancellations made 3-7 days before will receive a 50% refund. Cancellations made less than 3 days before are non-refundable.

Cancellation by Us

We reserve the right to cancel a booking if the generator becomes unavailable due to breakdown, damage, or other unforeseen circumstances. In such cases, we will offer an alternative generator or provide a full refund. We will not be liable for any consequential losses.

Weather-Related Cancellations

If severe weather makes delivery unsafe or impossible, we may postpone delivery. The hire period will be adjusted accordingly. If the Hirer wishes to cancel due to weather, standard cancellation terms apply.

Legal & Administrative

Governing Law

These terms and conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Data Protection

We will process your personal data in accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy. Your data will be used for the purposes of fulfilling the hire agreement and may be shared with third parties where necessary for delivery, payment processing, or legal compliance.

Entire Agreement

These terms and conditions, together with the booking confirmation, constitute the entire agreement between the parties. Any variations must be agreed in writing.

Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Acceptance of Terms

By booking the generator through our website, you are bound by all our terms and conditions. By signing the delivery note or making payment, you confirm that you have read, understood, and agree to be bound by these terms and conditions. If you do not agree with any part of these terms, you should not proceed with the hire.
